Terms for the use of ayyzee.com and the services offered.

This English translation is provided for convenience only. In the event of any discrepancy, the German version shall prevail and is the only legally binding version.
Provider
1. Scope
These Terms and Conditions apply to the use of the website ayyzee.com and the services offered there, in particular the Ayyzee Web Search API, content extraction, research and web crawling functions.

2. Service description
Ayyzee provides an API for real-time web search, content extraction, research and web crawling, in particular for AI agents, RAG workflows and agentic systems.
The services may, among other things, provide structured search results, extracted content, summaries, metadata and other machine-readable information.
There is no entitlement to specific search results, complete indexing of specific websites or permanent availability of specific functions.
3. Registration and API access
Registration may be required to use certain functions. After successful registration, the user may receive an API key.
The user is obliged to treat access data and API keys confidentially and to protect them from unauthorised access. Passing them on to third parties is only permitted with the prior consent of the provider.
The provider is entitled to temporarily or permanently block API keys in the event of abuse, security risks or violations of these Terms.
4. Usage plans, prices and limits
Ayyzee may offer free and paid usage plans.
The free plan currently includes 10,000 API calls per month. Paid plans, higher limits, team functions, SLA options and enterprise offers can be agreed separately.
The prices and service descriptions published on ayyzee.com at the respective time apply. The provider may set usage limits, rate limits and technical restrictions.
5. Payment terms
For paid services, the prices displayed at the time of conclusion of the contract apply. Payments can be made via the offered payment methods, in particular credit card, PayPal, SEPA direct debit or invoice for enterprise customers.
Unless otherwise agreed, paid subscriptions are billed monthly and can be cancelled monthly.
6. Permitted use
The user may only use the services lawfully and within the scope of these Terms.
In particular, the following is prohibited:
- use for unlawful, fraudulent or abusive purposes,
- circumventing rate limits or security mechanisms,
- use to create or distribute malware, spam, phishing or attack code,
- infringement of copyright, data protection rights or other rights of third parties,
- automated mass querying contrary to technical or contractual restrictions,
- use for unlawful surveillance, profiling or deanonymisation of persons.
7. AI-generated and web-based content
Ayyzee provides information from publicly accessible web sources or technically retrievable content. The results may be incomplete, outdated, incorrect or misleading.
The provider does not guarantee the correctness, completeness, up-to-dateness or legal admissibility of the provided content.
The use of the results in AI systems, agents, chatbots, RAG systems or other applications is at the user's own responsibility.
Ayyzee does not provide legal, tax, medical, financial or security advice.
8. User responsibility
The user is themselves responsible for whether and how the data obtained via Ayyzee is further processed, stored, published or integrated into their own products.
The user must ensure that their use is compatible with applicable law, data protection regulations, copyright, terms of use of third-party sites and other rights of third parties.
9. Availability and technical changes
The provider endeavours to ensure reliable availability of the services. However, uninterrupted availability is not guaranteed.
Maintenance work, updates, security measures, technical disruptions or force majeure may lead to restrictions.
The provider may change, extend, restrict or discontinue functions insofar as this is necessary for technical, economic, legal or security-related reasons.
10. Third-party content and third-party providers
Ayyzee may collect, process or display content, links or data from third-party sites. For third-party content, the respective third party is solely responsible.
The display or processing of third-party content does not constitute approval, recommendation or legal review by the provider.
11. Rights to the platform
All rights to the website, software, API, documentation, trademarks, designs, databases and other components of Ayyzee remain with the provider or the respective rights holders.
The user merely receives a simple, revocable, non-exclusive and non-transferable right to use the services within the contractually agreed scope.
12. User data and data protection
The processing of personal data is carried out in accordance with the privacy policy of Ayyzee.
The user is responsible for not transmitting personal data, confidential information or other sensitive content via the API unless there is a legal basis for doing so.
13. Security
The user may not carry out security checks, penetration tests, load tests or other interventions in the systems of Ayyzee unless this has been expressly permitted in writing.
Security vulnerabilities should be reported responsibly to info@ayyzee.com.
14. Blocking and termination
The provider may block or terminate the user's access if the user violates these Terms, payment arrears exist, security risks arise or unlawful use is suspected.
The user may cancel paid subscriptions in accordance with the respective plan. Payment claims already incurred remain unaffected.
15. Liability
The provider's liability is unlimited in cases of intent, gross negligence and injury to life, body or health.
In cases of simple negligence, the provider is only liable for breach of essential contractual obligations. In this case, liability is limited to the foreseeable, typical contractual damage.
Liability for indirect damages, loss of profit, data loss, business interruptions or damages caused by incorrect search results is excluded insofar as legally permissible.
16. Indemnification
The user shall indemnify the provider against claims by third parties arising from unlawful or contractual use of the services by the user.
This also includes reasonable costs of legal defence.
17. Changes to the Terms
The provider may change these Terms if there are substantive reasons, in particular due to changes to the services, the legal situation or technical requirements.
The user will be informed of significant changes in an appropriate manner. If the user continues to use the services after the changes come into effect, the changes are deemed accepted insofar as legally permissible.
18. Applicable law and jurisdiction
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If the user is a businessman, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered office of the provider.
19. Final provisions
If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.
The statutory regulation shall apply in place of the invalid provision.
